Terms of Use
These Terms of Use are the agreement between you and KARD ("KARD", "we", "us") for the KARD website and apps. By creating an account or using KARD you accept them. If you do not accept them, do not use KARD.
The short version. You must be 18 or older. Be honest and respectful. Sell only real cards you own and ship what you promise. Posting, commenting and liking cost a small amount of KARD, and spent KARD is not refunded. KARD is a community coin, not an investment. We may remove content and suspend accounts that break the rules.
1. Who can use KARD
- You must be at least 18 years old. We check the date of birth you give when you sign up.
- You must give accurate information and keep one account for yourself. Do not sell, share or transfer your account.
- You may not use KARD if you are in, or ordinarily resident in, a country or region subject to comprehensive United States sanctions, or if you are on a sanctions list. We may block access from those places and screen linked wallets.
- You are responsible for everything done through your account, so keep your password and any authenticator codes private and tell us at once if you think someone else has access.
2. Your content
Posts, comments, photos, showcases, listings, messages and other material you add are your content. You keep ownership of it. You give us a worldwide, non-exclusive, royalty-free licence to host, store, display, translate, reformat and distribute it so that KARD can work, including showing it to other members and sending it to our service providers. The licence ends when you delete the content or your account, except for copies that are needed to complete orders and trades, keep legal records, or sit in backups until they expire.
You promise that you own your content or have the right to share it, and that it does not break the law or anyone's rights.
3. Rules for everyone
You must follow the Community Guidelines. We have zero tolerance for objectionable content and abusive behavior, including harassment, hate, threats, sexual content, content that exploits or endangers minors, scams, and illegal goods. Posts, comments, avatars and photos are screened automatically, and every post, comment, listing and member can be reported or blocked. We review reports and aim to respond within 24 hours. We may remove content, give a strike, and suspend or close accounts, without notice where the harm is serious.
4. The KARD coin
Some actions in KARD use KARD, a community coin on the Solana network. The cost is shown before you confirm. Amounts you spend on posts, comments and likes are not refunded, including when content is later removed for breaking the rules. KARD is not an investment or a security, we make no promise that it has or will keep any value, and nothing on KARD is financial, tax or legal advice. The details are in the KARD Coin and Rewards Terms.
5. Buying, selling and trading
KARD provides a venue where members buy, sell and trade physical trading cards. The contract for a sale or trade is between the members involved. Sellers are responsible for their listings, for describing cards honestly and for shipping on time. Buyers are responsible for paying and for raising problems within the inspection period. Fees, shipping, inspection, disputes, refunds and seller holds are set out in the Marketplace Rules, which are part of these Terms. Where required, we or our payment partner collect and remit sales tax on orders; you are responsible for any other taxes.
Payments are processed by Stripe and shipping labels are bought through Shippo. Their terms apply to the services they provide, and we are not responsible for their systems.
6. Card information and values
Card names, images, details and market values come from us and third-party data providers and from scanning, and can be wrong or out of date. Values are estimates for information only. They are not appraisals, offers, or advice. Check a card yourself before you buy, sell or trade.
7. Intellectual property and trademarks
KARD, its software, design and brand belong to us and our licensors. You may use KARD only as these Terms allow. MLB, NBA, NFL, Pokémon, Magic: The Gathering, One Piece and other marks belong to their owners. KARD is independent and is not affiliated with or endorsed by them. To report content that infringes your copyright, see Copyright and DMCA.
8. Suspension, closing your account and deleting it
We may suspend or close an account that breaks these Terms or the policies they refer to, puts others at risk, or is used for fraud. Three strikes lead to suspension. You can delete your account at any time in Settings (see Delete your account). Orders, trades and ledger records that we must keep by law are kept, with your personal details removed.
9. Privacy
Our Privacy Policy explains what personal data we collect and how we use it. By signing up you confirm that you have read it.
10. Disclaimers
KARD is provided "as is" and "as available". To the fullest extent the law allows, we do not promise that KARD will be uninterrupted or error-free, that members' listings, content or identities are accurate, or that any card is authentic. We are not a party to sales or trades between members. Some places do not allow some of these exclusions, so some of them may not apply to you.
11. Limits on our liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive losses, or for lost profits, lost data or loss of the value of KARD, and our total liability to you for any claim about KARD is limited to the greater of the fees you paid us in the 12 months before the claim and 100 US dollars. Nothing in these Terms limits liability that cannot be limited by law, such as for fraud or for death or personal injury caused by negligence.
12. Changes to these Terms
We may update these Terms. For a material change we will tell you in the app or by email before it takes effect, and the "last updated" date and version at the top of this page will change. If you keep using KARD after the change takes effect you accept the new Terms. We record which version you accepted and when.
13. Governing law and disputes
These Terms are governed by the laws of the United States and of the state in which KARD's operating company is organized, without regard to conflict-of-law rules. Please contact us first so we can try to settle a dispute informally. If we cannot, the courts of that state have jurisdiction, except where the law of your place of residence gives you the right to go to court there. If any part of these Terms cannot be enforced, the rest still applies. Translations of these Terms are provided for convenience and the English version controls.
